What is a lasting power of attorney?+

An LPA lets you appoint trusted people to make decisions about your finances or your health and welfare if you later lose capacity. There are two types, and a lawyer can prepare and register them correctly, usually as a fixed fee.

What if my relative has already lost capacity?+

If there is no LPA in place, you may need to apply to the Court of Protection to be appointed as a deputy. This is more involved than an LPA, and a lawyer can guide the application from start to finish.

Why set up an LPA now if I am well?+

Because an LPA can only be made while you still have capacity. Putting one in place early avoids the cost, delay, and uncertainty of a deputyship application if illness or an accident happens later.
